Gay Marriage Opponents: Legal Strategies

Challenges to same sex marriage continue today even as the weddings are being performed. One of them will be in Sacramento where it will be alleged the proper hearings and legislative action to approve gay marriage hasn't occurred. 

The November ballot initiative for a constitutional amendment against same-sex marriage looms large in the debte. Opponents allege gays have too many rights in California already.

"Now," says Karen England of the Capitol Resource Institute, "they want to hijack the word 'marriage'."

But will voters approve a constitutional amendment?

"People generally shy away from changing the Constitution," says Mark DiCamillo of the Field Poll. "That's something you set in stone and it can't be reviewed again by the courts."

DiCamillo's poll recently found slightly over half of California voters are against changing the constitution to ban same sex marriage.
